This Privacy Policy (“Policy”) is entered into between Highway Delivery, a food delivery service provider (hereinafter referred to as the “Company”), and the individual registering or engaged as a delivery partner/delivery personnel (hereinafter referred to as the “Delivery Partner”).

This Policy governs the collection, use, storage, processing, and protection of personal information of Delivery Partners while providing delivery services on behalf of the Company.

1. Definitions

“Personal Information” means any information that identifies or can be used to identify a Delivery Partner, including but not limited to name, contact details, identification documents, bank details, and location data.

“Services” means food delivery and related logistics services performed by the Delivery Partner for the Company.

“Applicable Law” includes all laws, rules, regulations, and guidelines applicable in India, including data protection and privacy laws.

The Company may collect the following Personal Information from the Delivery Partner:

• Full name, address, date of birth, and contact number
• Government-issued identification documents (Aadhaar, PAN, Driving License, etc.)
• Vehicle details, including registration and insurance
• Bank account and payment-related details
• Real-time location data during active delivery assignments
• Order history, delivery performance, and service-related records

3. Purpose of Collection and Use

The Personal Information collected shall be used for the following lawful purposes:

• Verification of identity and eligibility of the Delivery Partner
• Assignment, monitoring, and completion of delivery orders
• Payment processing, incentives, and settlements
• Customer support, grievance handling, and dispute resolution
• Compliance with Applicable Laws and lawful requests by authorities
• Improving operational efficiency and service quality

4. Location Data

4.1

The Company may collect and process real-time location data of the Delivery Partner strictly during active delivery hours.

4.2

Location data shall be used solely for operational purposes, including navigation, delivery tracking, and customer updates.

4.3

The Company shall not use location data for unauthorized surveillance or personal monitoring.

5. Disclosure and Sharing of Information

5.1

The Company shall not sell, rent, or trade the Personal Information of Delivery Partners.

5.2

Personal Information may be shared only with:

• Customers, limited to delivery-related details
• Restaurant or merchant partners, as required for order fulfillment
• Payment gateways and financial institutions
• Third-party service providers engaged for operational purposes
• Government or law enforcement authorities, where required under Applicable Law

6. Data Security

6.1

The Company shall implement reasonable security practices and procedures to safeguard Personal Information against unauthorized access, misuse, loss, or alteration.

6.2

Access to Personal Information shall be restricted to authorized personnel only.

7. Confidentiality Obligations of Delivery Partner

7.1

The Delivery Partner agrees to maintain strict confidentiality of customer data, order details, and Company information.

7.2

The Delivery Partner shall not misuse, disclose, or retain customer Personal Information beyond the purpose of delivery.

7.3

Any breach of confidentiality may result in termination of engagement and legal action under Applicable Law.

8. Data Retention

8.1

Personal Information shall be retained only for as long as necessary to fulfill the purposes outlined in this Policy.

8.2

Certain data may be retained for statutory, legal, or regulatory requirements even after termination of the Delivery Partner’s engagement.

9. Rights of Delivery Partner

Subject to Applicable Law, the Delivery Partner shall have the right to:

• Access their Personal Information
• Request correction or updating of inaccurate data
• Request deletion of Personal Information, subject to legal obligations

10. Amendments

The Company reserves the right to amend or modify this Policy at any time. Any such changes shall be communicated through official channels, and continued engagement shall constitute acceptance of the revised Policy.

11. Governing Law and Jurisdiction

This Policy shall be governed by and construed in accordance with the laws of India. The courts having jurisdiction over the registered office of Highway Delivery shall have exclusive jurisdiction.
